1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Bihpur P.S. Case no.502 of 2021 registered under sections 498A, 494, 323, 506 and 34 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act.
3. As per the prosecution case, the informant states that she was married to the petitioner herein in the year 2009. At the time of marriage, various articles by way of gift as stated in the FIR was given. It is further stated that the petitioner who happens to be the husband used to torture and assault her. He finally married for a second time with one Kajal Kumari. As

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The allegation of torture, demand of dowry and assault etc. are all false and concocted. It was the informant who abandoned the petitioner which led to the petitioner filing a suit for restitution of conjugal rights under section 9 of the Hindu Marriage Act which was registered as Matrimonial Case no.69/2021 in the Court of learned Principal Judge, Khagaria. The petitioner is in custody since 26.11.2025 and chargesheet has been submitted in the case. He has no criminal antecedent and the allegation of him having married again is incorrect.
5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the FIR, the submissions made on behalf of the petitioner, pendency of the suit for restitution of conjugal rights, the petitioner having remained in custody since 26.11.2025 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Bihpur P.S. Case no.502 of 2021 on furnishing bail bond of Rs.10,000/
Patna High Court CR. MISC. No.14155 of 2026(2) dt.12-03-2026 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Naugachia, District Bhagalpur.
