Petitioner is an accused in connection with Madhepura P.S. Case No. 881 of 2019 registered under Sections 302, 201, 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the instant case. It is further submitted that the petitioner has no criminal antecedent and he is in custody since 03.01.2020.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that petitioner is father of the deceased. There is allegation of murder against him. On perusal of Postmortem Report, it is apparent that the cause of death is due to strangulation and in the instant
Patna High Court CR. MISC. No.10859 of 2020(4) dt.08-06-2020 2/2 case, no F.I.R. is lodged by father or mother for their missing girl. Hence, the petitioner does not deserve the privilege of bail.
