Petitioners are languishing in custody since 07.04.2017 in connection with Amour P.S. Case No. 149/16 for offences punishable under Sections 341, 323, 324, 325, 307, 354, 34 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that the petitioners along with other persons inflicted severe injury by means of rod, knife and lathi on the informant, her husband and one Biltu Harizan.
It has been submitted by the learned counsel for the petitioners that they are innocent and have falsely been implicated in the aforesaid case as both sides are neighbours,
Patna High Court Cr.Misc. No.23288 of 2017 (3) dt.22-06-2017 2/2 distantly related to each other and there was some dispute regarding fishing from the pond. It is submitted that all the injuries have been found to be simple in nature caused by hard blunt substance.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-VIth, Purnea, in connection with Amour P.S. Case No. 149/2016. (Nilu Agrawal, J) Rajesh/- U T
