JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-07-2019 Learned counsel for the petitioner submits that the petitioner has been compelled to move this Court when the Misc. (E.C. Act) Appeal No. 100/18-19 preferred before the Collector, Bhagalpur has not been disposed off till date. Learned counsel for the State submits that in the given facts and circumstances of the case, the Collector, Bhagalpur be directed to consider and dispose off the pending appeal, if any, within a reasonable time.
In the facts of the present case, this Court finds that Misc. (E.C. Act) Appeal in this case was preferred in the year 2018 meaning thereby about one year has gone past. If the appeal has not been considered and disposed off till date, it is an alarming situation and invites the attention of this Court calling
Patna High Court CWJC No.4240 of 2019(2) dt.11-07-2019 2/2 for a direction the Collector, Bhagalpur to hear and dispose of this appeal within 60 days from the date of receipt/production of a copy of this order.
Let the appeal be heard and disposed off on merit with a reasoned order within 60 days from the date of receipt/production of a copy of this order and the same be communicated to the petitioner within next 15 days, failing which the consequences shall follow.
