The petitioner seeks bail in Hilsa P.S. Case No.554 of 2019, registered under Sections 356, 379 and 34 of the Indian Penal Code.

The informant alleged that three persons came on a motorcycle and snatched his mobile. Thereafter they started fleeing away but on alarm, police came there. Seeing the police, the motorcyclists started fleeing away leaving the motorcycle on the spot. Two persons, namely, Tuntun Kumar @ Sanjeev Kumar, the petitioner, and Deepak Kumar were apprehended. The apprehended accused did not disclose the name of persons who fled away leaving the motorcycle on the spot. Learned counsel for the petitioner submits that the petitioner was pillion rider. The petitioner is in jail since 24.10.2019. The petitioner has got no criminal antecedent. Considering the facts that although the petitioner is said to be arrested while fleeing away after snatching the mobile but no snatched mobile was recovered from possession of the petitioner, only motorcycle is said to have been recovered and the petitioner has remained in jail for more than four months, petitioner, namely, Tuntun Kumar @ Sanjeev Kumar is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa at Nalanda in connection with Hilsa P.S.
