2. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant, who is his own brother. It is next submitted that petitioner is a person with clean antecedent and is in custody since 14.12.2023. It is further submitted that similarly situated co-accused Tandal Kumar @ Tandan Kumar @ Tandle Kumar Vs. The State of Bihar, who had approached this Court seeking anticipatory bail by filing Cr. Misc. No.18201 of 2024 and the same was allowed by an order dated 01.04.2024.

3. It is further submitted that the case of the petitioner if not akin is similar to the case of Tandal Kumar. It is also submitted that Tandal Kumar has been granted the privilege of

Patna High Court CR. MISC. No.15431 of 2024(3) dt.26-04-2024 2/2 anticipatory bail and the petitioner in the instant case is seeking regular bail. It is also submitted that petitioner will not abscond, rather will cooperate in the trial.

4. The learned APP for the State opposes the bail application.

5. Considering the submissions made by the learned counsel for the petitioner and taking into consideration the order dated 01.04.2024 in Cr. Misc. No.18201 of 2024, the petitioner above-named is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Auranbagad in connection with Barun P.S. Case No.615 of 2023.

6. However, in the event if the learned trial court comes to a conclusion that petitioner after being released on bail is trying to delay the trial in any manner, the trial court would be at liberty to cancel the bail bonds of the petitioner.

7. The application stands allowed.
