The petitioner seeks bail in Mali P.S. Case No. 16 of 2017 registered for the offence punishable under Sections 30(a) and 38 of the Bihar Excise (Amendment) Act, 2016. The accusation is that in course of checking of the vehicle one Tata Indigo Car was searched from which 1050 pouches of 200 ml country made liquor was recovered in which four persons including the petitioner was found sitting. It has been submitted on behalf of the petitioner that the petitioner has committed no offence and has falsely been implicated in this case merely on suspicion. The petitioner is in custody since 05.03.2017. Similarly situated co-accused persons
Patna High Court Cr.Misc. No.25079 of 2017 (2) dt.06-06-2017 have already been allowed bail by a coordinate Bench of this Court in Cr.Misc.No.20931 of 2017 vide order dated 17.05.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Mali P.S. Case No.16 of 2017.
