The petitioner seeks bail in connection with Kotwali (Barari) P.S. Case No. 637 of 2016, registered under Section 395 of the Indian Penal Code.
Learned counsel for the petitioner submits that in course of investigation one Jangli Sah was apprehended in this case, who disclosed the name of five other persons and in course of investigation one Deepak Sah in his confessional statement disclosed the name of this petitioner having hand in this case, except the confessional statement nothing has been collected by the I.O to connect the petitioner in the present case. Further submission is that petitioner is accused in four other cases and
Patna High Court Cr.Misc. No.23455 of 2017 (3) dt.28-06-2017 2/2 due to that reason, Police got managed to implicate the petitioner in this case and the petitioner is in custody since 13.01.2017. Further submission is that co-accused Deepak Das, who has disclosed the name of this petitioner has also been released on bail by a co-ordinate Bench of this Court on 26.04.2017 passed in Criminal Miscellaneous No. 15833 of 2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P.S. Case No. 637 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
