The petitioner seeks regular bail in connection with Bihta P.S. Case No. 164 of 2018 registered for the offence punishable under Sections 420, 409/34 of the Indian Penal Code.

The allegation is regarding the petitioner having engaged in impersonation in the examination being conducted in relation to B.A. Part-II.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner has a clean antecedent and is languishing in custody since 17.12.2018. It is further submitted that similarly situated co-accused person has already been

Patna High Court CR. MISC. No.11952 of 2019(2) dt.26-02-2019 2/2 granted bail by an order dated 20.12.2018 passed by a coordinate Bench of this Court in Criminal Misc. No. 72678 of 2018.

Per contra, Shri Mishra, learned counsel appearing for the State has vehemently opposed the prayer for bail. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Danapur, Patna in connection with Bihta P.S. Case No. 164 of 2018.
