JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-10-2020 Mr. Manoj Kumar, learned counsel for the petitioner submits that a show cause has been filed on behalf of the deponent today. In the show cause it is stated that so far as Kawakole P.S. Case No. 36 of 2015 and 32 of 2015 are concerned, those two cases relate to another person, namely, Ram Bilas Yadav son of Dwarka Yadav, resident of village Tetariya. It is stated in the case diary in paragraph '130' that the name is mentioned as Ram Bilas Yadav but because learned APP for the State could not found the father's name and village's name there in the case diary, this Court was informed that those two cases are also against the petitioner. Learned counsel, however, submits that it is true that in the present case the petitioner has been arrested after a period of nine years. Learned APP for the State submits that he has
Patna High Court CR. MISC. No.11329 of 2020(7) dt.12-10-2020 2/2 returned the case diary and, therefore, it is not possible to verify this fact.
Considering the facts and circumstances of the case and the show cause filed by the deponent wherein he has categorically stated about those two cases and it has also been stated that in those two cases the said accused Ram Bilas Yadav has been granted bail in Cri. Misc. No. 2916 of 2016 on 01.02.2016 and Cri. Misc. No. 3098 of 2016 on 18.03.2016 copies whereof have been brought on record vide Annexure '3', this Court is of the view that the reasons stated in the show cause are fit to be accepted and no further order may be passed in respect thereof. The show cause is, thus, accepted. The application stands disposed of.
