ABHISHEK REDDY ORAL ORDER 31-10-2025 The only prayer sought for in the present CWJC is seeking a direction to the Respondent No. 2 to dispose of the Encroachment Case No. 07 of 2022 and Encroachment Case No. 08 of 2022 which are pending adjudication.

2. Learned counsel appearing on behalf of the petitioners submits that though the said cases have been filed in the year, 2022, the same have not been disposed of till date. Therefore, the learned counsel seeks the indulgence of this Court to direct the Collector-cum-District Magistrate, Nalanda (Respondent No. 2) to pass necessary final orders by fixing a time frame.

3. Per contra, the learned counsel appearing on behalf

Patna High Court CWJC No.3692 of 2025(3) dt.31-10-2025 2/2 of the Respondent-State submits that he has no objection if a direction is given to the Respondent No. 2 to pass necessary orders strictly in accordance with law.

4. Having regard to the above made submissions, without going into the merits or demerits of the case, the present writ petition is disposed of directing the Collector-cum-District Magistrate, Nalanda (Respondent No. 2) to dispose of the Encroachment Case No. 07 of 2022 and Encroachment Case No. 08 of 2022 pending before him, if not already disposed of, as expeditiously as possible preferably within a period of twelve weeks from the date of the receipt of the copy of this order. It is needless to observe that before passing any orders, the petitioners and other parties to the proceedings shall be given an opportunity of hearing.

Any order passed shall be communicated to the party.

5. With the above directions, the present Writ Petition stands disposed of.
