JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-05-2015 The petitioners apprehend their arrest in Warisnagar (Mathurapur O.P) P.S. Case no. 90 of 2013 registered under sections 323, 341, 307/34 of the Indian Penal Code. The petitioners have not moved before this Hon'ble Court earlier either for anticipatory bail or for regular bail in this matter.
Allegedly the petitioners and Lal Babu Mahto father-in-law sprinkled K. Oil and burnt the mother and sister of the informant and thereafter due to alarm being raised villagers came and thereafter they were brought to hospital. Submission is of false implication and that no eye witness has come forward to support the prosecution case.
Patna High Court Cr.Misc. No.13201 of 2015 (3) dt.21-05-2015 2/2 The informant is the son of Lakshman Mahto and as such the allegation that the petitioner is step father is no reliable. Learned A.P.P. opposes the prayer for bail.
Considering that the informant at once asked from his mother and sister, who narrated about the occurrence stating the hands of the petitioners and co-accused and as such this court is not inclined to grant privilege of pre arrest bail to the petitioner.
