2. This is an application for grant of regular bail on behalf of the petitioner in connection with Special (NDPS) Case No.141 of 2020, registered for the offences under Sections 8(c), 20(B)(ii)(C), 29 and 35 of the NDPS Act.

3. There is recovery of 607 kg of ganja from a truck.

4. The petitioner is in jail since 18.09.2020 and claims clean antecedent.

5. It has been submitted by the learned counsel for the petitioner that the trial is being delayed by the prosecution therefore, the petitioner may be granted bail.

6. Learned counsel for the N.C.B. submits that he will produce the witnesses on the date fixed and the N.C.B. will not

7. Accordingly, this application is dismissed with a direction to the N.C.B. to get the trial concluded at the earliest.

8. The Magistrate is also directed to conclude the trial by examining the witnesses on the date fixed. If the N.C.B. delays the trial, this Court will take action against the Investigating Officer of this case.

9. Let a copy of the order be communicated to the District Judge, Patna forthwith through FAX or e-mail for its compliance.
