====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-07-2026 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 103(1), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.

3. Prosecution case, in brief, is that informant suspects that all the F.I.R. named accused persons, including this petitioner, shot dead the father of informant due to land dispute.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant based on suspicion. It is next submitted that the father of the informant was killed and cause of death in the postmortem was recorded as cardio respiratory failure due to external bleeding and shock caused by firearms. It is further submitted that no doubt the father of the informant was killed by

Similarly situated co-accused, namely, Rohit Modi and Bharat Modi have already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 21.07.2026 passed in Cr. Misc. No. 45417 of 2026. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case, nature of accusation, clean antecedent and claim based on parity, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Khaira P. S. Case No. 323 of 2025, subject to condition as laid down under Section 482(2) of the BNSS. (Prabhat Kumar Singh, J) Navya/- U T
