The petitioner apprehends his arrest in Malsalami P.S. Case No. 87 of 2013, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The informant named the petitioner along with others and alleged that they all came on Scorpio vehicle and made firing and they forcibly took Narad Kumar. They assaulted Narad Kumar with bricks and stones. The petitioner was driving the vehicle. Learned counsel for the petitioner submits that the investigating officer did not find the manner of occurrence true. It is submitted that on account of rash and negligent driving of the vehicle Narad Kumar sustained injury and died. Be that as it may there is very specific allegation that he

Patna High Court Cr.Misc. No.6474 of 2015 (2) dt.18-02-2015 2/2 was driving the vehicle and crushed the injured Narad Kumar, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
