JUSTICE SUDHIR SINGH ORAL ORDER 21-12-2016 Heard the learned counsels for the parties.

The petitioner was granted provisional bail vide Cr.Misc.No.25711 of 2015 dated 23.9.2015 with a direction to surrender within a period of four weeks. The said provisional bail was granted to him for a period of three months on account of the undertaking made by the petitioner that the said order will be complied within the period of three months. It was further directed that the provisional bail of the petitioner shall be confirmed only after the Life Insurance Policy in question of the informant is revised within the period of three months.

Thereafter, a modification application was filed vide

Patna High Court Cr.Misc. No.11846 of 2016 (8) dt.21-12-2016 2/3 Cr.Misc.No.11846 of 2016 praying further time for surrender in the court below for furnishing of the bail bond and for compliance of the earlier order. Vide order dated 30.3.2016 interim protection was granted to the petitioner. The petitioner was directed to comply with the undertaking given by him in the earlier application i.e. Cr.Misc.No.25711 of 2015. Ultimately vide order dated 7.1.2016 the matter was settled between the parties and the provisional bail granted to the petitioner was confirmed. It has been pointed out that since there was an interim protection granted to the petitioner vide order dated 30.3.2016 the petitioner had not surrendered and has not furnished the bail bond in respect to the provisional bail granted to him.

Considering the aforesaid facts and circumstances, as the matter has already been settled between the parties, in the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Complaint case No.

The earlier order dated 23.9.2015 passed in Cr.Misc.No.25711 of 2015 is modified to the extent as indicated above.
