That this application is directed to command the respondent to proceed in accordance with law in terms of enquiry report dated 6.8.2019 conducted by Chief Vigilance Officer, Bihar School
Patna High Court CWJC No.3856 of 2022(2) dt.15-12-2022 2/3 Examination Board, Patna, pursuance to order dated 22.8.2019 passed in CWJC No. 6403/2017 by this Hon'ble Court."
The learned Senior Counsel for the petitioner has submitted that the private respondent no. 10 had approached this Court, by filing a writ petition bearing CWJC No. 6403 of 2017, wherein a coordinate Bench of this Court, by a judgment dated 22.8.2017, had granted liberty to the District Programme Officer (Establishment), Patna to get the matter, pertaining to the genuineness of the certificate of the Respondent No. 10, verified from the Secretary, Bihar School Examination Board, Patna. It is further submitted that in pursuance to the said judgment dated 22.8.2017, the Chief Vigilance Officer, Bihar School Examination Board, Patna, had got the matter inquired and has submitted a report dated 6.8.2019, however, thereafter, no steps have been taken, hence, the petitioner be granted liberty to approach the Respondent authorities for
Patna High Court CWJC No.3856 of 2022(2) dt.15-12-2022 3/3 impressing upon them to take appropriate steps, in accordance with the report, submitted by the Chief Vigilance Officer, dated 6.8.2019. Liberty, so sought, is granted.
It is needless to state that in case, the concerned authority proposes to take any action against the Respondent No. 10, they shall first issue notice to the Respondent No. 10, hear him and after complying with the principles of natural justice, pass appropriate orders.
The writ petition stands disposed of on the aforesaid terms.
