Mr. A.M.P.Mehta, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2020 Nobody appears on behalf of the petitioner on repeated calls.
It appears that on 19.12.2019 at the request of the learned counsel for the petitioner, case was posted on 20.12.2019 as the last indulgence. Again on 07.01.2020 nobody appears on behalf of the petitioner. However, for the ends of justice, kept in today's list retaining its position. Today also nobody appears on behalf of petitioner to press this application.
This application has been filed for quashing the order dated 23.12.2014 passed by Sri R.R. Sahay, learned Judicial Magistrate, Bettiah, West Champaran, in Gopalpur P. S. Case No. 49 of 2014, by which, cognizance has been taken against the petitioner for the offences under Sections 467, 468, 471 and
Patna High Court CR. MISC. No.12272 of 2015(6) dt.08-01-2020 2/2 420 of IPC.
Case in short is that a written report was filed by the informant on the direction of the Block Development Officer, Chanpatiaya stating that the petitioner has been selected as Panchayat Teacher in the Government Primary School, Malahi Tola and on an enquiry, his testimonials were found forged and he was also terminated from the service and the present F.I.R. was directed to the lodged against him.
Heard learned APP also.
From perusal of the record, it appears that there are prima facie allegation against the petitioner and it is not a case that no case is made out against the petitioner from perusal of the F.I.R. and other materials available on the record. In view of the above, I find no merit in this application. As such, this application stands dismissed. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
