The petitioner is accused in connection with Siwan Muffasil P.S. Case No. 608 of 2017 registered under Sections 30(a) and 37(b) of the Bihar Excise Act, 2016. The accusation is that, on seeing the police party, one person started to flee away throwing his bag, but on chased, he was apprehended in drunken state and in his presence, his bag was searched, from which, 10 bottles each containing 200 ML country made liquor was recovered.

Learned counsel for the petitioner submits that alleged country made liquor was not recovered from the conscious possession of the petitioner and petitioner is in custody since

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the In-Charge, Additional Sessions Judge-II, Siwan, in connection with Siwan Muffasil P.S. Case No. 608 of 2017. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
