====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 147, 148, 149, 341, 323, 324, 379, 307, 354(A), 506 of the IPC and 27 of the Arms Act. The prosecution story, in brief, is that the petitioner alongwith other accused persons have assaulted the brother-inlaw of the informant and also outraged the modesty of the informant and took her ornament. It is further alleged all the F.I.R. named accused persons have brutally assaulted the brother-in-law of the informant whose treatment is going on in P.M.C.H., Patna and his condition is critical. It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since

Patna High Court CR. MISC. No.11682 of 2020(2) dt.28-02-2020 2/2 04.12.2019. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. Vikash Kumar Yadav is alleged to have given Iron rod blow upon the victim. There is no allegation of assault against the petitioner. The petitioner was a member of unlawful assembly.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Danapur, in connection with Dulhin Bazar P.S. Case No. 302 of 2019.
