The petitioner has preferred this application for grant of regular bail in connection with Sitamarhi P.S. Case no. 924 of 2021 registered under sections 399 and 402 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act. As per the prosecution case, the informant states that on receiving information about the accused persons having gathered and making plan to commit dacoity, a raid was conducted. It is stated that from possession of the petitioner a loaded country made pistol was recovered and on unloading the same two live cartridges were also recovered. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the
Patna High Court CR. MISC. No.13556 of 2023(2) dt.15-05-2023 2/2 petitioner's possession who has been falsely implicated in the case for oblique reasons. The petitioner is in custody since 19.11.2021 and charge sheet has been submitted in the case. Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the FIR, the petitioner having remained in custody for 1 year 5 months since 19.11.2021 and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Sitamarhi P.S. Case no. 924 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi.
