JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 419, 420, 379/34 of Indian Penal Code.

As per prosecution case, one Central Bank ATM card, mobile phone, motorcycle and Rs. 20,000/- cash was recovered from co-accused Abhishek Kumar who disclosed the name of this petitioner as one of his accomplice.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has been made accused only on the basis of confessional statement of one co-accused namely, Abhishek Kumar. It is further submitted that no incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Biharsarif, Nalanda in Laheri P. S. Case No. 493 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
