JUSTICE SANJAY PRIYA ORAL ORDER 19-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Bihra P.S. Case No. 44 of 2017 instituted for the offence under Sections 457 and 380 of the Indian Penal Code.

As per the written report, the petitioner is said to have given threat to commit theft in the house of the informant. It is alleged that theft has been committed in the house of the informant and the informant raised suspicion against this petitioner.

From the impugned order, it appears that besides suspicion, one box is said to have been recovered but no TIP has been held.

Let the Petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Bihra P.S. Case No. 44 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
