The petitioner is in custody in connection with Azamnagar P.S. Case No. 124 of 2017, G.R. No. 1151/2017, for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. From perusal of the FIR, it appears that 47 bottles of Bengal made liquor was recovered from the hut of the petitioner.
The petitioner has stated in para-3 of the petition that he has no criminal antecedent and in paragraph 13 there is statement that the petitioner is a retired person from the Railway Department. In para-11 of the petition there is statement that the
Patna High Court Cr.Misc. No.22761 of 2017 (2) dt.08-06-2017 2/2 seizure list was not prepared in accordance with law. Having regard to the fact that the petitioner is a retired employee of the Railway Department and having no criminal antecedent as stated in para-3 and 13 of the bail application, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Katihar or the successor Court in connection with Azamnagar P.S. Case No. 124 of 2017 (G.R. No. 1151/2017), subject to the condition that the petitioner will extent full cooperation in conclusion of the trial and will not, in any manner, influence the witnesses.
