The petitioner seeks bail in a case registered for the offence punishable under Sections 302/201/34 of the Indian Penal Code.

Allegation against the petitioner along with other accused persons is said to have killed the daughter of the informant and tiding her mouth and hands by cloths and dropped her in Ganga River.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that in the present FIR out of five accused persons four are the in-laws family members of deceased, however, the petitioner is the outsider and co-villager of her inlaws and he no concern with the family affairs of deceased and her in-laws family members.

No.23023 of 2021(3) dt.26-10-2021 2/2 Learned counsel for the petitioner further submits that there is no eye witness in this case and no any incriminating articles has been recovered from the conscious possession of the petitioner. There is no specific overt act against the petitioner. The petitioner is languishing in judicial custody since 14.12.2020. The petitioner has got no criminal antecedent which is mentioned in para 3 of the bail petition. Charge sheet has been submitted in this case.

Learned APP for the State vehemently opposed the prayer for bail application.

Considering the aforesaid facts and circumstances of the case and that the petitioner is not the family member of the deceased and there is no specific overt act against him, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Muffasil P.S. Case No. 257/2020 corresponding to G.R. No. 2079/2020 to the satisfaction of learned Court below where the case is pending/ successor Court.
