JUSTICE SHIVAJI PANDEY ORAL ORDER 20-08-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual court proceeding. In this case, the petitioner is seeking bail in Kurhani P.S. Case No. 612 of 2019 registered for offence punishable under Sections 25 (1-b)a, 26 and 35 of the Arms Act. The allegation against the petitioner is that 300 pieces of live cartridges of 7.65 mm were recovered from his possession, however, counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. It is urged that similarly situated co-accused person has been granted bail vide Cr. Misc. No. 21647 of 2020 by this Court and the petitioner is in custody since 15.09.2019. It is claimed that his antecedent is clean.
Considering the facts and circumstances of the case,
Patna High Court CR. MISC. No.11082 of 2020(4) dt.20-08-2020 2/2 the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-3rd, West Muzaffarpur in connection with Kurhani P.S. Case No. 612 of 2019 subject to condition that one of the bailor will be the close relative of the petitioner and further condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
