Petitioner, already in custody, seeks bail in connection with Sahebpur Kamal P.S. Case No.122 of 2017, corresponding to Sessions Trial No.604 of 2017, registered under Section 394 of the Indian Penal Code.

Allegation in brief is that four motorcycle borne miscreants looted cash of Rs.90,000/- from the cash box of the petrol pump and also opened fire.

Learned counsel for the petitioner submits that there is no recovery of either the arms or the money from possession of the petitioner, merely on the basis of the confessional statement of a co-accused, the petitioner has been implicated in this case, the

Patna High Court Cr.Misc. No.15127 of 2018(2) dt.21-03-2018 2/2 recovery of the arms and motorcycle said to be used is from Raja Sahni and Saurabh Thakur. It is also submitted that petitioner was not put on TIP though the informant claims to identify the miscreants and charge-sheet has been submitted against him.

Having considered the aforesaid facts and circumstances, petitioner Rajan Das is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VIth, Begusarai in connection with Sahebpur Kamal P.S. Case No.122 of 2017, corresponding to Sessions Trial No.604 of 2017 with a condition that the petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
