JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-05-2015 This is an application for anticipatory bail for the petitioner who has been made accused in Muffassil P.S. Case no. 125 of 2014 for the offence punishable under sections 406, 409, 353 of the I.P.C. pending in the court of Sub-Divisional Judicial Magistrate, Munger.

That no any anticipatory or regular bail application filed earlier by the petitioner before this Hon'ble Court in this case.

Allegedly during inspection of Anganbari Centre No. 89 to which the petitioner is Sevika, several irregularities have been found and the number of children were found less than the number showing and further during the inquiry nuisance was created and the complainant Nusarat Praveen was assaulted.

Patna High Court Cr.Misc. No.13215 of 2015 (3) dt.21-05-2015 2/2 Submission is of false implication and that instead of instituting the first information report the petitioner ought to have been persued in departmental proceeding. No offence as alleged is made out. The petitioner has been made victim of the circumstances and she being the lady deserves sympathetic consideration to which the learned A.P.P. opposes. In the facts and circumstances of the case and considering the gender of the petitioner in the event of her arrest or surrender before the court below within a period of two months from the date of receipt/production of a copy of this order be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of S.D.J.M, Munger in Muffasil P.S. Case no. 125 of 2014, subject to the conditions as laid down under section 438(2) Cr.P.C.
