The petitioner seeks bail in a case instituted under Sections 30(A) of the Bihar Prohibition and Excise Act, 2016. It is alleged that 143. 280 liters of foreign liquor is said to have been recovered from the water tank of the hotel of the petitioner. Thereafter seizure list was prepared. It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.04.2017. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. There is no compliance of Section 100 of the Cr.P.C.
On behalf of the state it has been submitted that the
Patna High Court Cr.Misc. No.24673 of 2017 (3) dt.30-05-2017 2/2 petitioner is named in the Complaint.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-7th-cum-Special Judge, Excise Act, Begusarai, in connection with Complaint Case No. 116C 2 of 2017.
