JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2020 The petitioner, who is a person of clean antecedents and is in custody since 31.12.2019, seeks bail in connection with Ramgarh P. S. Case No. 305 of 2019 dated 31.12.2019 corresponding to Excise Case No. 01 of 2020 instituted for the offences under Section 414 of Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

34.080 litres of foreign liquors is said to have been recovered from a Nano vehicle which was occupied by the petitioner and two others.

It has been urged on behalf of the petitioner that the vehicle was intercepted on the statement of co-

Patna High Court CR. MISC. No.16688 of 2020(2) dt.13-05-2020 2/2 accused Suraj Kumar. The recovery shown to have been made from the vehicle is stated to be sham.

Considering the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge III cum Special Judge, Excise, Kaimur at Bhabhua in connection with Ramgarh P. S. Case No. 305 of 2019.
