JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307 and 504/34 of the Indian Penal Code.
The accusation against the petitioner is of assaulting with rod on the head of the informant causing bleeding injury. It is submitted by learned counsel for the petitioner that the petitioner is agnate of the informant and no injury was actually caused to the informant. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for
Patna High Court Cr.Misc. No.13854 of 2015 (2) dt.11-05-2015 2/2 regular bail of the petitioner if he surrenders within a period of six weeks in connection with Ahiyapur P.S. Case No. 316 of 2012 pending in the court of learned CJM, Muzaffarpur. Accordingly, the application is disposed of.
