Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Mali P.S. Case No. 11 of 2020 lodged under Sections 25(1-b)a, 26, 35 of the Arms Act.

As per the prosecution case, recovery of motorcycle in the possession of the petitioner as well as the other materials and arms as per the seizure list.

Learned counsel for the petitioner submits that petitioner is innocent. The arms was not recovered from the possession of the petitioner, he further submits that petitioner is

Patna High Court CR. MISC. No.13120 of 2022(3) dt.10-08-2022 2/2 in custody since 08.02.2020, charge sheet has already been filed and on the earlier occasion, a report of trial was called for. Learned counsel for the State opposes the prayer for bail and submits that the recovery of articles alleged in the present case. He also submits that petitioner has earlier moved and his bail application was rejected vide order dated 24.08.2021 by the Co-ordinate Bench.

From the report received, it transpires that three prosecution witnesses has already been examined and there is likelihood that trial shall be concluded within two months. In this background I am hereby rejected the bail petition at present. Petitioner shall renew his prayer for bail after four months if trial shall not be concluded.
