The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 120(B) of the Indian Penal Code and 25(1B)a, 26 and 35 of the Arms Act Recovery is of arms and ammunitions from the shop and motorcycle of co-accused Amod Kumar Sah. It transpired that the petitioner took the motorcycle for sometime from co-accused Amod Kumar Sah hence, it was suspected that he kept the arms in the motorcycle.
It is submitted by learned counsel for the petitioner that only on suspicion accusation has been levelled and recovery has been made from the shop and motorcycle of co-accused Amod Kumar Sah and considering the same co-accused Md. Meraj @ Guddu has been granted anticipatory bail by this Court
Patna High Court Cr.Misc. No.9827 of 2015 (2) dt.11-03-2015 2 / 2 vide Cr. Misc. No. 3304 of 2015.
Considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Araria P.S. Case No. 398 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Araria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
