2. The petitioners are apprehending their arrest in connection with Murliganj P.S. Case No. 23/2023 dated 17.01.2023 registered for the offence punishable u/ss 341, 323, 324, 379, 307, 327, 447, 504 and 506 read with 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioners and the co-accused persons came holding lethal weapons started abusing. On being objected by the informant's brother and nephew, the co-accused Vijay Yadav assaulted on the head of

Patna High Court CR. MISC. No.15987 of 2024(2) dt.02-04-2024 2/3 the informant's brother with iron rod with an intent to kill, causing injury. The other co-accused persons also assaulted the informant's nephew.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioners have no criminal antecedent as stated in para 3 of the bail petition. There is general and omnibus allegation against the petitioners. The specific allegation of assault is against the co-accused Vijay Yadav. As per Annexure-2, the injury is stated to be simple in nature caused by hard and blunt substance.

5. Learned A.P.P. for the State has vehemently opposed the prayer of anticipatory bail of the petitioners.

6. Considering the aforesaid facts and circumstances of the case as well as the injury being simple in nature, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Madhepura in connection with Murliganj P.S. Case No. 23/2023, subject to conditions as laid down under Section

Patna High Court CR. MISC. No.15987 of 2024(2) dt.02-04-2024 3/3 438(2) of the Code of Criminal Procedure.

7. This application stands allowed.
