The petitioner apprehends his arrest in a case registered for the offence under Section 7 of the E.C.Act. Allegation against this petitioner is that during surprise inspection, he was apprised that petitioner had no D.A.P. in his shop whereas on search, three bags of D.A.P. besides other fertilizers were found in the shop for the purpose of black-marketing of the same.

Entire allegation, as alleged in the F.I.R., are false and concocted. There is no complaint by any customer or villager against petitioner that he is indulged in black-marketing of fertilizers. Petitioner holds license of retail fertilizer. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.15670 of 2023(2) dt.18-05-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Chapra in connection with Dariyapur P.S. Case No. 636 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
