JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 09-07-2020 Heard learned counsel for the petitioner and learned counsel for the State via video conferencing. The petitioner has filed the present application for grant of pre-arrest bail in connection with Piro (Hasanbazar) P.S. Case No. 317 of 2019 registered for the offences punishable under Sections 341, 323, 308 and 504/34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that though there is allegation against the petitioner that he assaulted with an iron rod on the head of the informant, the injury report annexed at Annexure-2 to the application would suggest that the injury was simple in nature. It is contended that the other co-accused persons against whom also omnibus allegation of assault with lathi, danda has been made,
Patna High Court CR. MISC. No.12588 of 2020(2) dt.09-07-2020 2/2 have already been granted bail by the court below itself. Learned counsel for the State has opposed the application for grant of bail to the petitioner. Considering the nature of the offence, the allegation made against the petitioner as also the fact that some other co-accused persons have already been granted pre-arrest bail by the court below, the petitioner is directed to be released on bail in the event of his arrest or surrender before the court below, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Piro (Hasanbazar) P.S. Case No. 317 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Ashwani Kumar Singh, J) rohit/- U T
