JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-03-2015 Heard learned counsels for the petitioner and the State. The petitioner being PDS dealer is apprehending arrest in a case registered for the offences punishable under Section 7 of the E.C. Act.

On the direction of the District Magistrate, the S.D.M., Hathua lodged FIR on the basis of report of the D.S.O. with regard to the irregularities in distribution of the essential commodities. It is submitted by the learned counsel for the petitioner that the shop of the petitioner was inspected on 3.8.2014 whereas the case has been lodged on 19.8.2014 and for the concerned irregularities the licence of the petitioner has been cancelled and there is nothing on record that the petitioner has not cooperated in the enquiry or is not cooperating with the investigation.

No.12720 of 2015 (2) dt.27-03-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Gopalganj in connection with Vijaipur P.S. Case No. 130 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
