This is an application for grant of anticipatory bail in connection with Begusarai P.S. Case No.95 of 2018, disclosing offences under Sections 341, 323, 307, 504, 34 of the Indian Penal Code.
So far as allegation of assault by bamboo is on petitioners no.2 & 4 and petitioner no.1 is named in the F.I.R. Submission of the learned counsel for the petitioners
Patna High Court CR. MISC. No.11484 of 2019(6) dt.26-06-2019 2/2 is that there is land dispute between the parties and no specific allegation has been attributed against petitioner no.1 and no injury report is available on the case diary. Heard learned A.P.P. also.
Having heard both sides, on perusal of the file it appears that the injury and opinion on the injury report was called for, but the same has not been received. As such, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M., Begusarai, in connection with Begusarai P.S.
