JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-02-2020 The petitioner, who is in custody since 12.10.2019, seeks bail in connection with Dumra P.S. Case No. 334 of 2019, dated 01.09.2019, instituted for the offences under Sections 188, 379, 414 and 34 of the Indian Penal Code and Section 52 of Prisoners Act and Section 59(i) (vii) of Jail Act, 1894.
While the petitioner was serving jail sentence in connection with a case of 302 I.P.C., he was found to be in possession of a mobile telephone.
Hence the present prosecution.

Patna High Court CR. MISC. No.11252 of 2020(2) dt.29-02-2020 2/2 for the petitioner has submitted that in the case in which the petitioner was earlier in jail, though he has been convicted but he has been granted bail by this Court in appeal.
Considering this aspect of the matter and the period of custody of the petitioner in the present case, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 334 of 2019. This application stands allowed.
