2. The petitioner has preferred this application for grant of regular bail in connection with Rajaon P.S. Case no.362 of 2025, registered under sections 115(2), 126(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act.
3. As per the prosecution case, the informant states that the petitioner along with two others came on a motorcycle. The petitioner fired upon the informant however the shot missed as the informant by that time entered the house of one Raju Jha.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. No such occurrence as alleged in the F.I.R. has taken place. The cause of false implication of the petitioner is his antecedents. He is in
Patna High Court CR. MISC. No.12311 of 2026(5) dt.08-07-2026 2/2 custody since 21.11.2025 and charge-sheet has been submitted in the case.
5. The application for bail is opposed by learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., no person having been injured in the entire occurrence, the petitioner having remained in custody for over 6 months since 21.11.2025 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Rajaon P.S. Case no.362 of 2025, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka.
