The petitioner seeks bail in connection with Bairiya P.S. Case No. 168 of 2018 instituted for the offence under Section(s) 302/34 of the Indian Penal Code.
Learned counsel for petitioner has submitted that petitioner is not named in the written report. The name of this petitioner has been disclosed by the informant in the protest petition filed in the court below.
It is alleged in the written report that some unknown persons caused injury on the neck of father of the informant by sharp cutting weapons who subsequently died.
Police has arrested this petitioner in Bairiya P.S. Case
Patna High Court CR. MISC. No.15521 of 2019(2) dt.13-03-2019 2/2 No. 389 of 2018 and implicated in the present case after recording confessional statement of this petitioner. Petitioner is in custody since 19.10.2018.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- IVth, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 168 of 2018 (G.R. No. 2139 of 2018) subject to the condition that both the bailors shall be the close relative of the petitioner.
