JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Pandarak P.S. Case No. 113 of 2018 registered for the offence punishable under Section 30(a) of Bihar Excise Amendment Act, 2016.
FIR disclosed that there is recovery of 300 bottles, each containing 750 ML, 5856 bottles, each containing 180 ML from the pickup van and one Sudhir Kumar was arrested, who disclosed that he used to bring liquor for the petitioner and that apart the petitioner is accused in one more case of similar nature.
Submission of learned counsel for the petitioner is that he has falsely been implicated and on the basis of disclosure made by co-accused he has been made accused in this case and earlier also.

In view of above allegation and criminal antecedent, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may move for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
With the above observation, this application is dismissed.
