Petitioner seeks bail in C-I Case No.408 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

40 litres of country made liquor is alleged to have been recovered from the e-rickshaw of the petitioner. The petitioner was driving the vehicle and Md. Perwez was also sitting in the said vehicle. Both were apprehended. Learned counsel for the petitioner submits that the passenger was carrying bag. The petitioner is the owner and driver of the vehicle and he had no knowledge about carrying of liquor. The petitioner is in jail since 30.12.2019. The petitioner has already remained in jail for about two months.

No.10884 of 2020(2) dt.29-02-2020 2/2 Having considered the facts aforesaid, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned A.D.J. II -cumSpecial Judge (Excise Act), Katihar in connection with C-I Case No.408 of 2019.
