Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. The petitioner seeks bail in connection with a case registered for the offences punishable under Sections 20 and 22 of the N.D.P.S. Act.

Allegation is of recovery of 7 Kg. Ganja from a bag kept on a motorcycle bearing Registration No. BR07AK-4803. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. It is further submitted that the petitioner is the owner of the motorcycle and he has no concern with the seized articles (plastic bag) which was recovered from the co-accused, namely,

Patna High Court CR. MISC. No.13854 of 2022(3) dt.12-10-2022 2/2 Braj Kishore Yadav, The petitioner is in custody since 02.01.2022, is a person with clean antecedent and charge-sheet has been submitted in the case.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-Cum Special Judge N.D.P.S, Darbhanga in connection with PTN G.O NDPS Case No. 01 of 2022 arising out of Baheri P.S. Case No. 02 of 2022.
