JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 11-05-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 324, 307, 302 of the Indian Penal Code and Section 25(1-b)a, 26, 27, 35 of the Arms Act.

The allegation against the petitioner along with coaccused persons is that they assaulted the informant and his brother due to which he got injuries. It is further alleged that during this altercation cousin of the informant namely, Deman Singh got serious injuries and during treatment he died. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. She has falsely been implicated in this case. There is no specific

Patna High Court CR. MISC. No.14062 of 2023(3) dt.11-05-2023 2/2 allegation of firing attributed against the petitioner rather general and omnibus allegation attributed against her. The specific allegation of firing is against co-accused persons. It is further submitted that the petitioner has got no criminal antecedent. Moreover, she is languishing in judicial custody since 02.11.2022.

Learned APP appearing for the state and learned counsel for the informant have vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as being a lady, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ara Town P.S. Case No. 926 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara.
