NILU AGRAWAL ORAL ORDER 22-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 04.02.2017 in connection with Dehri Mahila P.S. Case No. 78 of 2016 registered for the offence punishable under Sections 498(A), 366(A), 323, 341, 406 and 506/34 of the Indian Penal Code and Sections 3/ 4 of the Dowry Prohibition Act.

The prosecution case, as lodged by the informant, is that her husband and in-laws have tortured her and demanded dowry and have turned her out of her matrimonial house. It has also been alleged that husband of the petitioner has lured his niece, Seema Kumari aged 16 years.

It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.22738 of 2017 (4) dt.22-06-2017 2/2 petitioner that he is innocent, has not committed any offence and even the victim girl Seema Kumari stated that she went to her uncle's house out of her own sweet will and no case of her abduction by the informant's husband has been lodged. It is further submitted that charge-sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.

However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Rohtas at Sasaram in connection with Dehri Mahila P.S. Case No. 78 of 2016.
