JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 16.5.2017 passed in Cr.Misc.No. 14124 of 2017 with direction to learned trial court to conclude the trial within a period of six months and if not concluded petitioner was given liberty to renew his prayer after framing of charge in this case.

Submission of learned counsel for the petitioner is that the victim lady has appeared in court and her statement under Section 164 Cr.P.C. was recorded denying the prosecution case and she has stated that she married one Shivdhan Mahto and she has disclosed her age as 21 years, which is Annexure-3 to this application.

Heard learned APP also.

No.8210 of 2018 (2) dt.28-02-2018 2/2 Having heard both sides and in view of facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge-II, Saharsa, in connection with Sessions Trial No. 84 of 2017, arising out of Sourbazar (B. Pur) P.S.Case No. 133 of 2016, subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in disposal of trial and appear before the court as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
