The petitioners apprehend their arrest in Jandaha P.S. case No. 277 of 2018 registered under Section 498A, 307 and other Sections of the Indian Penal Code.
The informant made allegation that petitioners being in-laws of the informant brutally assaulted her and she somehow escaped from the house and came to the house of her parents. The learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.11601 of 2019(2) dt.26-02-2019 2/2 prior to institution of this case the husband filed Matrimonial case No. 183 of 2018 against the informant. The petitioners have no manner of concern with the family affairs of the informant and her husband. The FIR was lodged after much delay. It is further submitted that injuries are bruises and the doctor opined the injuries to be caused within four days. Considering the facts aforesaid and the nature of allegation made against the petitioners and the fact that petitioners are in-laws of the informant, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.
10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateXI, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 277 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
