The petitioner has been in custody since 12.11.2017 in connection with Khagaria P.S. Case No. 794 of 2017 for the offence registered under Sections 25(1-b)A/26/35 of the Arms Act.

Learned counsel for the petitioner submits that the motorcycle in question belongs to the present petitioner and no arms were recovered from his conscious possession. It is further submitted that the petitioner is also not having any criminal antecedent.

Considering the aforesaid facts and circumstances of the case and that the recoveries were not made from the possession

Patna High Court Cr.Misc. No.5741 of 2018 (2) dt.05-02-2018 of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case NO. 794 of 2017.
