The petitioner seeks bail in connection with Sessions Trial No.83 of 2016, arising out of Amarpur P.S. Case No.359 of 2015, registered under Sections 147, 148, 149, 341 and 302 of the Indian Penal Code besides Section 27 of the Arms Act, pending in the court of the Adhoc Additional Sessions Judge-I, Banka.
The prayer of the petitioner for grant of bail was rejected twice by this Court, lastly, vide order dated 12.04.2017 passed in Criminal Misc. No.9589 of 2017, taking into consideration the direct allegation against the petitioner to shot fire at the chest of the deceased.
Patna High Court Cr.Misc. No.13059 of 2018(2) dt.21-03-2018 2/2 Submission is that the petitioner is in custody since 08.12.2015.
Having regard to the facts and the circumstances of the case and also considering the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected.
